Welcome to NextXLiving Pvt. Ltd. (“Company”, “we”, “our”, or “us”).

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and the Company regarding your use of our website https://www.nextxliving.com/, our mobile application, and all related online and offline services (collectively referred to as the “Platform”).

Please read these Terms carefully. By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, Refund & Cancellation Policy, and any additional policies displayed on our Platform.

If you do not agree with these Terms, please do not use the Platform.

NextXLiving Pvt. Ltd. is a private limited company registered under the Companies Act, 2013, with its registered office at:

The Company operates as a property lessee and property management service provider, facilitating occupancy, management, and maintenance of residential and co-living spaces under lawful lease arrangements.

3. Scope of Services

Our Platform and services include, but are not limited to:

  1. Facilitating discovery, leasing, and occupancy of properties.
  2. Managing and maintaining leased or subleased premises.
  3. Providing digital interfaces for communication, payment, and service management.
  4. Offering access to vendors, service partners, and maintenance solutions.
  5. Collecting and managing rent and other payments on behalf of property owners, wherever applicable.

The Company may modify, suspend, or discontinue any aspect of its Services at its sole discretion, without prior notice.

4. Eligibility and User Obligations

You may use the Platform only if:

  • You are at least 18 years old; and
  • You have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.

By registering or using the Platform, you represent that:

  1. The information you provide is true, accurate, and complete.
  2. You will maintain the confidentiality of your account credentials.
  3. You will not use the Platform for illegal, harmful, or fraudulent purposes.
  4. You will comply with all applicable laws, including property, tenancy, and data protection laws.

You are solely responsible for all activities conducted under your account.

5. Account Registration and Security

Certain services may require account creation. You agree to:

  • Provide accurate and current information during registration;
  • Keep your login credentials secure; and
  • Notify us immediately at https://www.nextxliving.com/ in case of unauthorized access.

The Company shall not be liable for losses arising from unauthorized use of your account.

6. Property Listings and Transactions

  1. Property listings are provided either directly by owners or through authorized representatives.
  2. We make reasonable efforts to verify authenticity but do not guarantee accuracy, completeness, or suitability.
  3. The final lease, license, or occupancy agreement governs the terms of occupation and use.
  4. The Company reserves the right to accept or reject any booking or user request without assigning reasons.

7. Payments, Charges, and Refunds

a. Payments

All payments must be made through secure, authorized payment gateways integrated with the Platform. The Company does not store full payment card information.

b. Security Deposits and Rent

Deposits, rent, and maintenance charges are governed by the applicable lease or occupancy agreement.

c. Refunds

Refunds, where applicable, are processed in accordance with our Refund & Cancellation Policy available on the Platform.

d. Taxes

All payments are subject to applicable taxes, including GST, in accordance with Indian law.

8. User Conduct and Restrictions

You agree not to:

  1. Misrepresent your identity or provide false information.
  2. Upload or transmit unlawful, defamatory, obscene, or infringing content.
  3. Interfere with Platform functionality or security.
  4. Reverse-engineer, decompile, or attempt to extract Platform code.
  5. Circumvent payment systems or engage in off-platform transactions.

Violation of these conditions may result in account suspension or legal action.

9. Intellectual Property Rights

All content, features, and functionality of the Platform, including text, graphics, software, logos, designs, and data, are the exclusive property of NextXLiving Pvt. Ltd.

They are protected under applicable copyright, trademark, and design laws. You may not reproduce, modify, distribute, or commercially exploit any part of the Platform without prior written consent.

10. Privacy and Data Use

Your use of the Platform is governed by our Privacy Policy, which explains how we collect, store, process, and protect personal data.

By using the Platform, you consent to such lawful data processing.

11. Service Partners and Vendors

The Company may engage third-party service providers for maintenance, furnishing, housekeeping, or facility-related services.

While vendors are bound by confidentiality and service-level obligations, the Company is not responsible for their independent actions beyond contractual scope.

12. Disclaimers

  1. The Platform and services are provided on an “as-is” and “as-available” basis.
  2. The Company disclaims all warranties, express or implied.
  3. We do not guarantee uninterrupted or error-free operation.
  4. We are not responsible for losses caused by force majeure events, including natural disasters, cyberattacks, or regulatory changes.

13. Limitation of Liability

To the maximum extent permitted by law, NextXLiving Pvt. Ltd. shall not be liable for:

  • Indirect, incidental, consequential, or punitive damages;
  • Errors or inaccuracies in listings or transactions;
  • Delays or service disruptions due to external factors;
  • Unauthorized access to user data.

Total liability shall not exceed the amount paid by the User for the service giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless NextXLiving Pvt. Ltd., its officers, employees, and partners from claims or damages arising from:

  • Violation of these Terms;
  • Misuse of the Platform;
  • Infringement of third-party rights;
  • Breach of applicable law.

15. Suspension and Termination

The Company may suspend or terminate access if:

  • These Terms are breached;
  • There is fraud, misuse, or security risk;
  • Required by law or authority.

Upon termination, your right to use the Platform ceases immediately.

16. Dispute Resolution and Governing Law

Disputes shall be resolved through amicable negotiation. If unresolved, they shall fall under the exclusive jurisdiction of the courts at Lucknow, Uttar Pradesh.

These Terms are governed by the laws of India.

17. Modification of Terms

Continued use of the Platform constitutes acceptance of the modified Terms.

These Terms, together with the Privacy Policy, Refund & Cancellation Policy, and other referenced documents, constitute the entire agreement between you and NextXLiving Pvt. Ltd.

By accessing or using the Platform, you confirm that you have read, understood, and agreed to these Terms and Conditions.
